Terms of Service

The rules for using the portal

Who can hold an account, who pays for a deal, what may and may not be uploaded, and what the portal is — and isn't — responsible for.

01The agreement

These terms are a contract between you and EliteHomePortal for use of the portal, the website, and the portal as embedded on an agent’s own site (together, the “Service”). By creating an account, signing in with a link we send you, or using the Service, you agree to them. If you use the Service on behalf of a brokerage or lender, you confirm you have authority to bind that organisation.

Our Privacy Policy explains how we handle your information and forms part of these terms.

02What the Service is — and isn't

The Service is a coordination tool: a shared, role-based record of a real-estate transaction for the client, the agent and the lender, which continues as a record of the home after closing.

It is not a lender, a title or escrow company, a brokerage, or a legal, tax or financial adviser, and it does not replace the contracts, disclosures and records those parties provide. Dates, statuses, figures and notes in the portal are entered by the professionals on your deal; the authoritative versions are the documents you receive from them directly. Estimated closing figures are labelled “subject to change” and remain estimates until your final Closing Disclosure.

03Accounts and roles

  • Clients (buyers, sellers, renters) are added to a deal by the professional running it and sign in with a link sent to their email. Keep that mailbox secure; anyone with access to it can open your portal.
  • Agents and lenders create an account with a work email and password and are responsible for everything done under it. Tell us promptly if you believe it has been compromised.
  • Brokers and administrators may see an overview of deals and the activity log across a team.

You must be at least 18 and provide accurate information. You may not share an account, use someone else’s, or access a deal you are not a party to.

04Deals, ownership and who pays

Whoever creates a deal — an agent or a lender — owns that deal and is the paying party for it. The professional they invite onto it joins that deal free of charge, for that deal only; the free invitation cannot be used to create or attach other deals. Either professional may subscribe to create deals of their own.

If two professionals create separate records for the same transaction, the Service may detect the duplicate and ask you to merge them. The owner of a deal may close, edit or delete it; deleting a deal removes it for every person on it.

05Subscriptions and billing

Paid plans are billed in advance on a recurring basis through our payment provider until you cancel. You can cancel at any time from your billing page; access continues until the end of the period you have paid for, and fees already paid are not refunded except where the law requires. We may change prices with at least 30 days’ notice, taking effect at your next renewal. Taxes may apply.

06What you may upload

The Service sorts every document by type. Contracts, addenda, inspection reports, title sheets and invoices may be stored. Pre-approval letters, Loan Estimates and Closing Disclosures are recorded as summaries that link to the lender’s or title company’s own system.

You must not upload, forward or paste loan applications, bank statements, pay stubs, tax returns, credit reports, or wire instructions or confirmations containing account or routing numbers — into a document, a note, a message or a bug report. The Service refuses such files at upload and has no override; if one nevertheless reaches us in another form we may remove it without notice.

You are responsible for the content you add and confirm you have the right to share it with the people on the deal. You must not upload anything unlawful, infringing, malicious or misleading.

07Acceptable use

  • Do not attempt to access deals, accounts or data you are not entitled to, or to probe, disrupt or overload the Service.
  • Do not use the Service to send spam, to harass anyone, or in breach of fair-housing, consumer-protection or real-estate settlement laws.
  • Do not copy, resell or embed the Service other than through the embedding tools we provide to agents for their own site.
  • Do not use the Service to request or direct wire transfers; the portal never carries wiring instructions.

08Your content and our service

You keep ownership of everything you add. You give us the permission needed to store, display and deliver it to the people on the deal, to sort and search it, and to keep it as part of the deal’s record, for as long as it is on the Service. We own the Service itself, its design and software.

You can download your documents at any time. If your account or a deal is deleted, we remove its content as described in the Privacy Policy.

09Third-party links and services

The Service links out to documents on lender and title-company systems, and relies on providers for hosting, email and payments. We are not responsible for those third parties’ content or services. Vendor contacts listed on a deal are added by the agent; the Service does not endorse or rate vendors.

10Ending the agreement

You may close your account at any time. We may suspend or end access if these terms are broken, if a subscription goes unpaid, or where required by law, and will tell you why unless the law prevents it. Sections that by their nature should survive — including content permissions needed to keep a deal record for other parties, disclaimers and limits of liability — continue after termination.

11Disclaimers and limits of liability

The Service is provided “as is” and “as available”. We work to keep it accurate, secure and running, but we do not guarantee it will be error-free or uninterrupted, or that information entered by other users is correct. Always confirm dates, figures and instructions with your agent, lender and title company directly.

To the fullest extent the law allows, EliteHomePortal is not liable for indirect, incidental, special or consequential loss, or for loss of profits, data or goodwill, arising from the Service, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim (or one hundred US dollars if you paid nothing). Some jurisdictions do not allow certain limits; in those places our liability is limited to the extent permitted.

12General

These terms are governed by the laws of the United States and the state in which EliteHomePortal is organised, and any dispute will be heard in the courts there, unless the law where you live gives you the right to something different. If a part of these terms is found unenforceable, the rest still applies. We may update these terms; material changes will be posted here with a new effective date and, where appropriate, notified to you. Continuing to use the Service after a change means you accept it.
